{"id":3423,"date":"2019-02-20T11:35:12","date_gmt":"2019-02-20T09:35:12","guid":{"rendered":"https:\/\/sb-bg.com\/?p=3423"},"modified":"2020-10-02T13:19:22","modified_gmt":"2020-10-02T10:19:22","slug":"obligation-to-identify-beneficial-owners","status":"publish","type":"post","link":"https:\/\/sb-bg.com\/bg\/2019\/02\/20\/obligation-to-identify-beneficial-owners\/","title":{"rendered":"Obligation to identify beneficial owners"},"content":{"rendered":"<div class=\"fusion-fullwidth fullwidth-box fusion-builder-row-1 nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\" style=\"--awb-border-radius-top-left:0px;--awb-border-radius-top-right:0px;--awb-border-radius-bottom-right:0px;--awb-border-radius-bottom-left:0px;--awb-flex-wrap:wrap;\" ><div class=\"fusion-builder-row fusion-row\"><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-0 fusion_builder_column_1_1 1_1 fusion-one-full fusion-column-first fusion-column-last\" style=\"--awb-bg-size:cover;\"><div class=\"fusion-column-wrapper fusion-flex-column-wrapper-legacy\"><div class=\"fusion-text fusion-text-1\"><p style=\"font-weight: 400;\">The\u00a0<strong>Law on Measures against Money Laundering<\/strong>, adopted in 2018, and its Implementing Rules, in force since January 2019,\u00a0introduce the requirements of the Directive (EU) 2015\/849 of the European Parliament and of the Council of May 20th 2015 on the\u00a0<strong>prevention of the use of the financial system for the purposes of money laundering or terrorist financing.<\/strong><\/p>\n<p style=\"font-weight: 400;\">A substantive change is the\u00a0<strong>obligation for legal persons<\/strong>\u00a0<strong>to provide information<\/strong>\u00a0<strong>about their actual owner<\/strong>, data on the persons representing them and managing them and their business activity to state bodies and legal entities defined by the law.<\/p>\n<p style=\"font-weight: 400;\">This information should be provided to the\u00a0<strong>Registry Agency<\/strong>\u00a0<strong><u>in the period from February 1, 2019 to May 31, 2019.<\/u><\/strong><\/p>\n<p style=\"font-weight: 400;\">This shall be done by submitting a Declaration with a notary certification of the signature of the manager of the company stating:<\/p>\n<ul>\n<li style=\"font-weight: 400;\">who is the actual owner \/ owners<\/li>\n<li style=\"font-weight: 400;\">who are the legal entities through which directly or indirectly control is exercised<\/li>\n<li style=\"font-weight: 400;\">contact person&#8217;s data in the Republic Bulgaria.<\/li>\n<\/ul>\n<p style=\"font-weight: 400;\">The Declaration shall be accompanied by certificates of good standing for the legal entities holding company ownership.<\/p>\n<p style=\"font-weight: 400;\">In the case of non-compliance, the law provides for a\u00a0<strong>pecuniary penalty<\/strong>\u00a0of BGN 1 000 to BGN 10 000, which will be imposed\u00a0<strong>every month<\/strong>\u00a0until the registration is filed.<\/p>\n<p style=\"font-weight: 400;\">Should you need assistance on this matter, the Sb Accounting &amp;
